Who We Are
The Tribunal office is located in Victoria, BC; it consists of a
Tribunal Chair and Vice Chair, staff, and approximately 115 members located
throughout the province. The Tribunal is independent from the ministry. The
Tribunal Chair reports to the Minister, Social Development and Poverty Reduction
Chair, Employment and Assistance Appeal Tribunal
Marilyn McNamara worked as a member of the Employment and Assistance Appeal Tribunal, since its establishment in 2002, and was appointed Chair in April 2006.
Since her appointment, she established a number of governance tools following best practices for administrative tribunals. Previously, Ms. McNamara worked for BC Ferries as the Manager, Corporate Services, responsible for access and privacy legislation as Information and Privacy Officer. Ms. McNamara holds a Bachelor of Science from Memorial University of Newfoundland; a Master of Laws, specializing in administrative law, and a Graduate Diploma in Justice System Administration, both from Osgoode Hall Law School, York University. She has a Master of Arts in Dispute Resolution at the University of Victoria and certification in Mediation and Negotiation from the Justice Institute of British Columbia.
Marilyn is Vice President of the Council of Canadian Administrative Tribunals (CCAT), Chair of the CCAT Professional Development Committee, a member of the Organizing Committee for the annual symposium and a member of the Access to Justice Committee. Marilyn is a member of the BC Council of Administrative Tribunals and participates on their Education Committee.
Nielsen is a panel member and acting Tribunal Chair with the Employment and
Assistance Appeal Tribunal. Previously, she was a contractor with the Ministry
of Labour and Citizens' Services, Corporate Accounting Services. In the
community, she is a Director of the Oak Bay Heritage Foundation and as a former
volunteer at the Ronald McDonald House and Success By 6. Ms. Nielsen holds her
Bachelor of Arts and her Bachelor of Laws from the University of British
Daniel Graham is retired as a Director from the Ministry of Forests,
Lands and Natural Resource Operations with the BC Government. Previously, he
was a Lawyer and Consultant with DM Graham Ltd. and a Lawyer with Davis and
Company. Active in the community, he is a volunteer lawyer with Access Justice
BC and the Chair of the Discipline Committee with the Association of BC Forest
Professionals. Previously, Mr. Graham was President of the Victoria Chapter of
the Crohns and Colitis Foundation Canada and a Reserve Constable with the
Vancouver Police Department. Professionally, he is a member of the Law Society
of BC and a member of the Association of BC Forest Professionals. Mr. Graham
holds his Diploma in Forest Resources from the BC Institute of Technology, his
Bachelor of Laws from the University of BC, and his Master of Laws from Osgoode
Hall Law School.
